Terms of Service

Please read these Terms of Service carefully. By using fortifiedwall.com ("Site"), the Digital Estate Planning portal, or our services, you agree to these terms. Our product Is This A Scam? has its own terms at isthisascam.email.

1. Acceptance

These Terms of Service ("Terms") are between you and FortifiedWall LLC ("we," "us," "our"). They apply to your use of the Site, the Digital Estate Planning portal ("Portal"), and our services: Digital Estate Planning, Practical Cybersecurity Speaking, and Cybersecurity Consultation. By accessing or using the Site, creating an account on the Portal, or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use the Site, Portal, or our services.

2. Our Services

Website. This Site provides information about FortifiedWall LLC, Family Cybersecurity Solutions, including our product Is This A Scam? (isthisascam.email), and our services: Digital Estate Planning, Practical Cybersecurity Speaking, and Cybersecurity Consultation.

Digital Estate Planning Portal. The Portal is an account-based service that helps you organize your digital footprint, store access information for your online accounts and digital assets, designate authorized contacts, and prepare instructions for your loved ones. The Portal is a tool for organizing and preserving digital information. It is not a legal will, trust, power of attorney, or substitute for professional legal, financial, or tax counsel. The Portal organizes information you provide but does not independently verify the accuracy, completeness, or currency of that information. You are solely responsible for keeping your stored data accurate and up to date.

Practical Cybersecurity Speaking. We offer keynotes and workshops focused on the "big 3": humorous, informative, and culture-aware cybersecurity content. All presentation materials, slides, handouts, and related content are the intellectual property of FortifiedWall LLC. No recording, photography, or reproduction of presentation materials is permitted without our prior written consent. Individual speaking engagements are governed by separate booking agreements.

Cybersecurity Consultation. We offer one-on-one video consultations with a cybersecurity expert for individual questions or situations. A consultation is general guidance to help you think through your situation. It is not a substitute for legal, financial, or law-enforcement advice, and it is not a data-recovery or account-remediation service. We do not guarantee any particular outcome from a consultation.

Consultation payments, cancellations, and refunds. Cybersecurity Consultations are a paid service. The current price is shown at the point of purchase. Payment is processed by our third-party payment provider (Stripe) through an external payment link; FortifiedWall LLC does not receive or store your full payment-card details. You may reschedule or cancel a booked session by contacting us at least 24 hours before the scheduled start time for a full refund. Cancellations made less than 24 hours before the session, or missed sessions ("no-shows"), are non-refundable. If we cancel or are unable to hold a session for reasons within our control, you may choose a full refund or a rescheduled session. Refunds are issued to the original payment method through Stripe.

We do not offer 24/7 or round-the-clock services. Descriptions on the Site are for general information; specific offerings may vary.

3. Account Registration and Security

If you create an account on the Portal, you agree to the following:

  • Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
  • Accurate information. You must provide accurate and complete registration information and keep it current.
  • One account per person. Each individual may maintain only one Portal account.
  • Credential security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorized use of your account.
  • Suspension and termination. We may suspend or terminate your account if we reasonably believe you have violated these Terms, subject to the notice provisions in Section 13.

4. Designated Agents and Authorized Contacts

If you use the Portal, you may designate one or more individuals ("Designated Agents" or "Authorized Contacts") to access your stored data under conditions you define (such as death, incapacity, or other triggers you specify). By using this feature, you acknowledge and agree:

  • You are responsible for selecting your Designated Agents and defining the conditions under which they may access your data.
  • You must keep your designations current. If you wish to add, change, or revoke a Designated Agent, you may do so at any time through the Portal.
  • Before granting access to a Designated Agent, FortifiedWall will follow our identity verification procedures. We will make reasonable efforts to verify identity, but we cannot guarantee that verification will prevent all unauthorized access.
  • FortifiedWall is not liable for actions taken by a Designated Agent after access has been granted following our verification procedures.
  • Designated Agent access is subject to applicable law. If a court order, legal proceeding, or other legal requirement conflicts with your designations, we will comply with the law.

5. Contact and Inquiries

When you use our contact form, you agree to provide accurate information. We use your submission to respond to your inquiry and as described in our Privacy Policy. You must not use the contact form for spam, abuse, or any unlawful purpose.

6. Acceptable Use

You agree not to:

  • Use the Site or Portal for any illegal purpose.
  • Attempt to gain unauthorized access to our systems, data, or other users' accounts.
  • Transmit malware, harmful code, or any material that could damage or interfere with the Site or Portal.
  • Scrape, crawl, or automate access to the Site or Portal in a way that burdens our systems.
  • Use the Site or Portal to harass, threaten, or harm others.
  • Store illegal content, stolen credentials, or information obtained through fraud in the Portal.
  • Share your Portal account access with others or use the Portal to facilitate fraud or unauthorized access to third-party services.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

7. Intellectual Property

All content on the Site and Portal, including text, graphics, logos, icons, images, software, and design, is the property of FortifiedWall LLC or its licensors and is protected by applicable intellectual property laws. Speaking engagement materials (slides, handouts, recordings) are the property of FortifiedWall LLC unless a separate written agreement states otherwise.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Portal for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any content without our prior written consent.

8. Third-Party Links

The Site may contain links to third-party websites or services, including isthisascam.email. We are not responsible for the content, privacy practices, or availability of third-party sites. Accessing a third-party link is at your own risk, and you should review the terms and privacy policies of any third-party site you visit.

9. Disclaimers

The Site, Portal, and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing:

  • Content on the Site and Portal is for general information only and does not constitute professional legal, financial, tax, or technical advice. For specific advice, consult qualified professionals.
  • The Digital Estate Planning Portal is not a substitute for a legal will, trust, estate plan, or power of attorney. It is an organizational tool. You should consult an attorney for estate planning legal advice.
  • We do not guarantee that the information you store in the Portal is accurate, complete, or current. You are solely responsible for the data you provide.
  • Speaking engagement content is educational and informational. It is not professional cybersecurity consulting or advice tailored to your specific situation.
  • Cybersecurity Consultation sessions provide general guidance for your situation. They are not legal, financial, or law-enforcement advice, and they are not a data-recovery or account-remediation service.
  • We do not guarantee uninterrupted, error-free, or secure access to the Site or Portal.

10. Limitation of Liability

To the maximum extent permitted by law, FortifiedWall LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, arising from or related to your use of the Site, Portal, or our services, including but not limited to:

  • Loss of or unauthorized access to data stored in the Portal.
  • Actions taken by Designated Agents or Authorized Contacts after access is granted.
  • Inaccurate, incomplete, or outdated information you stored in the Portal.
  • Reliance on information provided on the Site or during speaking engagements.

Our total aggregate liability for all claims arising from or related to these Terms, the Site, Portal, or our services shall not exceed the greater of (a) the amount you paid to FortifiedWall LLC in the 12 months preceding the claim, or (b) one hundred dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless FortifiedWall LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: your violation of these Terms; your use of the Site, Portal, or our services; the accuracy or legality of information you store in the Portal; or actions taken by your Designated Agents after access is granted following our verification procedures.

12. Force Majeure

Neither party shall be liable for any delay or failure to perform obligations under these Terms due to events beyond reasonable control, including but not limited to natural disasters, pandemics, acts of government, war, terrorism, labor disputes, power or internet outages, or failures of third-party services. This provision is particularly relevant to speaking engagements, which may be affected by travel disruptions, venue closures, illness, or similar events.

13. Account Termination and Data

If you have a Portal account:

  • You may delete your account at any time through the Portal settings or by contacting us.
  • Data export. Before deleting your account, you may export your stored data (digital asset inventory, authorized contact information, and access instructions) through the Portal.
  • Data destruction. After account deletion, we will destroy your stored Portal data within 30 days, except where we are required by law to retain certain information.
  • Termination by us. We may terminate your account for violations of these Terms. Where practicable, we will provide reasonable notice and an opportunity to export your data before termination takes effect.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from or related to these Terms will be resolved in the state or federal courts located in Denton County, Texas, and you consent to the personal jurisdiction of those courts.

15. Changes

We may update these Terms from time to time. The "Effective Date" at the top will change when we do. For material changes that affect Portal account holders, we will provide notice via email at least 30 days before the changes take effect. Continued use of the Site or Portal after changes constitutes acceptance of the updated Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, Cookie Policy, and any separate service agreements (such as speaking engagement contracts or Digital Estate Planning engagement agreements), constitute the entire agreement between you and FortifiedWall LLC regarding your use of the Site, Portal, and our services.
